Elements of a Personal Protective Order:
Colorado courts thoughtfully assess the facts and law associated with allegations of domestic violence. Judges will issue personal protective orders (also referred to as restraining orders) if such an order is necessary to protect a party from imminent and ongoing threats.
Judges consider two questions when determining whether to issue a protective order. First, courts determine whether there is an “imminent” threat of physical or emotional harm. Second, courts assess whether that threat is likely to continue without a judge’s intervention.
