Record Sealing and Expungement

 Eligibility for Expungement: 

The following items may be sealed or expunged on criminal records:

1) arrests which did not lead to prosecution;

2) charges which have been dismissed;

3) charges which resulted in a not guilty verdict at trial;

4) charges which were dismissed after successful completion of a deferred sentence;

5) convictions for petty and municipal offenses;

6) convictions for some prostitution related offenses;

7) convictions for some drug related offenses; and

8) juvenile convictions. 

Expungement Procedure: 

Attorney James Frazier has successfully petitioned district courts to expunge serious charges for defendants, including expunging sex offenses. Generally, law enforcement agencies don’t object to expungements. Thus, most records are often sealed and/or suppressed a few weeks after filing.
